Insurance Terms of Service

Introduction

These terms and conditions (the "Terms") apply to the use of the non-fungible token ("NFT") provided by Health Potion Ltd ("we," "us," or "our"). By purchasing the NFT, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the NFT.

Description of the NFT

The NFT is a digital asset that serves as an insurance policy against losses resulting from scam transactions involving malicious smart contracts. In the event of a loss, the holder of the NFT (the "insured party") may be eligible to receive reimbursement from us at our discretion.

Eligibility for Reimbursement

To be eligible for reimbursement, the following conditions must be met:

• The insured party must have acquired the NFT through purchase from us.

• The insured party must be using Pocket Universe's prevention security tool at the time of the loss.

• The loss must be a direct result of a scam transaction involving a malicious smart contract.

• The insured party must provide us with all necessary information and documentation to support their claim.

Limitations and Exclusions

We will not reimburse the insured party for any losses resulting from the following:

• Losses not directly caused by a scam transaction involving a malicious smart contract.

• Losses resulting from the insured party's failure to use Pocket Universe's prevention security tool.

• Losses resulting from the insured party's violation of these Terms or any applicable laws or regulations.

• Losses resulting from the insured party's acquisition of the NFT through means other than purchase from us.

Disclaimer of Warranties

We provide the NFT and any related services on an "as is" and "as available" basis. We do not make any warranties or representations, express or implied, with respect to the NFT or any related services.

Limitation of Liability

We will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the NFT or these Terms. Our total liability to the insured party will not exceed the amount of the reimbursement paid by us under these Terms.

Changes to These Terms

We may change these Terms from time to time. If we make any material changes, we will provide you with notice as required by law. Your continued use of the NFT after any such changes constitutes your acceptance of the revised Terms.

Governing Law and Dispute Resolution

These Terms and any disputes arising out of or in connection with the NFT or these Terms will be governed by the laws of the State of California, without giving effect to any conflict of laws principles. Any dispute arising out of or in connection with the NFT or these Terms will be resolved through binding arbitration in accordance with the JAMS Streamlined Arbitration Rules and Procedures.

Entire Agreement

These Terms constitute the entire agreement between you and us with respect to the NFT, and supersede all prior or contemporaneous communications and proposals, whether oral or written. If any provision of these Terms is found to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
